Exceptions are cellars subject to a justices license or which are part of premises on a railway station. Contraventions may result in a fine upon conviction. A local authority consent may contain conditions. There are various powers available to a local authority in the Public Health Act and the Housing Act 1957 dealing with defective premises. However, the procedures there are very lengthy and where any premises are in such a defective state as to be prejudicial to health or a nuisance, a much faster procedure is available in the Building Act 1984.

Authority is given for new building regulations to provide that if, before the initial notice ceased to be in force a contravention of building regulations was committed with respect to work specified in the notice summary proceedings may be taken. This must be within six months of the initial notice ceasing to be of effect. If an initial notice has ceased to be in force and no final certificate has been given and accepted it is possible to give a new initial notice. However, where: • a plans certificate relates to any of the work, and • a plans certificate was given before an initial notice ceased, was accepted and not rescinded, or • the initial notice was given and accepted the responsibilities of an approved inspector do not apply to work contained in the new initial notice which is specified in the plans certificate.

This section does not apply to buildings covered by the Offices Shops and Railway Premises Act 1963. Replacing earth closets If there is a sufficient water supply and sewer available a local authority may require a water closet to be substituted for an earth closet. When this happens the council must pay one-half of expenses reasonably incurred. Loan of toilets When reconstruction, maintenance or improvement work necessitating disconnection of sanitary conveniences is being carried out, the local authority may supply on loan temporary sanitary conveniences.
